What is habeas corpus?
A case seeking a writ of habeas corpus is a federal lawsuit that asks a judge for an order declaring someone’s detention to be unlawful. If the judge agrees, the judge usually orders release or that an immigration judge conduct a bond hearing.
How do I know if I can file a habeas petition?
There are many different arguments that can be raised in a habeas petition and it really depends on how and when someone came into the United States, whether they have been charged with or convicted of certain crimes, and whether they have a removal order. Schedule a consultation with us today to discuss the specifics of your case.
